Renting a car is a convenient solution for travel, business trips and other situations when personal transportation is unavailable. But what to do if you have broken traffic regulations driving a rental car? Who is liable - the driver or the rental company? Will there be a fine? And what if the violation is recorded by a camera? Let's go point by point.

📍 Who is responsible for traffic violations: the tenant or the company?

The driver is always responsible for traffic violationsEven if the car is owned by another company. When you rent a car, you sign a contract stating that you are the temporary owner and user responsible for the operation of the car from the moment it is handed over to you.

That means:

  • if you were speeding;

  • ran a red light;

  • violated parking regulations;

  • drove through a toll-free stretch of road--

then the fines will be forwarded specifically for you.

📸 Violation detected by a camera: what next?

Ukraine has a system in place automatic registration of traffic violations. The cameras "see" the license plate number, but do not record the identity of the driver. That's why the fine notice comes car owneri.e. rental company.

What the company does:

  1. Receives a notice of violation.

  2. Matches the date and time of the lease to the contract.

  3. Identifies the renter driving the auto at the time of the violation.

  4. Either pays the fine itself and invoices the customeror handing over your data to the police.

Options for Consequences:

  • From you withhold the fine amount from the deposit.

  • You receive a notice to pay the fine directly.

  • The contract may include additional fee for administration of the fine (e.g., 200-500 UAH on top).

🚓 You have been stopped by the police: who pays?

If the violation occurred during a patrol stop (e.g., you didn't wear your seat belt, crossed a solid line, ran a red light), then:

  • fine is issued directly to you as the driver;

  • company is not involved in the process, you pay the fine in person.

If you do not have a Ukrainian driver's license (you are a foreigner), the protocol is still drawn up in your name and handed over for execution.

🅿️ Parking violations

Parking lot violations are a separate topic. If you are:

  • didn't pay for parking;

  • parked in the wrong spot;

  • blocked the exit/ sidewalk and the car was towed--

then:

  • the fine is issued to the owner of the car;

  • company can escrow;

  • may also be tow truck ticketand storage at the impound lot, etc.

Important: check whether parking is included in the rental price and which spaces are allowed to be used - this is indicated in the contract.

💳 What happens if you don't pay the fine?

Ignoring the fine is a bad idea. Possible consequences:

  • Rental company Withhold the amount from your collateral or bank card (if provided);

  • They can to give your information to the police;

  • In some cases (especially large fines or car accident cases), the company may:

    • to put you in customer blacklist;

    • refuse to cooperate in the future;

    • take legal action (rare but possible);

    • transfer the debt to debt collectors (in case of a lease in another country).

📘 What is stated in the lease agreement?

Be sure to read the contract! It prescribes:

  • Tenant Responsibilities;

  • Who pays the fines;

  • Possible administrative processing fees;

  • Dispute Resolution Procedure.

If you're not sure-- check all conditions with your manager before signing.

🔐 Is it possible to disclaim liability?

No. Even if the ticket comes later and you've already returned the car, it's a exempt. The landlord has every right to claim compensation from you, because the breach occurred during the term of the lease.

⚖️ What if the violation was not the driver's fault?

Sometimes there are controversial cases:

  • The camera mistakenly recorded the violation;

  • Another person violated (if you handed the wheel to a friend, which is prohibited by the contract);

  • There was a technical failure or an accident that was not your fault.

In such cases, you can:

  • contest the fine through electronic driver's office or in court;

  • provide the rental company with supporting documents (video, photos, witness statements).

But be warned: The argument "I didn't know" or "I didn't get the letter" does not exempt you from paying..

🧭 How to avoid problems?

  1. Observe traffic rules - especially behind the wheel of someone else's car.

  2. Do not pass the steering wheel to third parties - it's a lease violation.

  3. Watch the speed limitespecially in camera zones.

  4. Park properlyeven though "everybody does it."

  5. Keep receipts for fines and parking tickets.

  6. Check your mail and notifications from the M.I.A. or D.I.A. GSC.

  7. Check with the rental companyhow they process fines.

🧠 Conclusion

A traffic violation on a rental car is always a tenant's liabilitynot the rental company. Even if the violation is caught on camera, you will end up paying. So the best strategy drive carefullyand follow the rules and avoid unnecessary costs.

If you are in violation, don't panic. Pay the fine on time, don't delay, and be honest with your landlord. This way, you will maintain your reputation and be able to use the rental service in the future without problems.
