Compulsory insurance of civil liability of vehicle owners (OSAGO, or popularly known as "motor third party liability insurance") has been in force in Ukraine since 2005 and has long become a habitual requirement for all drivers. However, many people do not know that in certain situations the policy can be not legalize - and completely avoid fines and police complaints.

In 2025 there are clearly defined categories of drivers and vehiclesThere are a number of exemptions that are exempted from the purchase of "car insurance". But it is important to understand the nuances: not all benefits work automatically, and some exemptions apply only to certain types of vehicles and specific circumstances.

In this article, let's break it down, Who has the right to drive without MTPLWhat documents you should have with you, and what are the risks for those who mistakenly believe that they are "allowed".

1. Who is exempted from the need to obtain CMTPL insurance

According to the Law of Ukraine "On Compulsory Insurance of Civil Liability of Owners of Land Vehicles", there are several categories of vehicles which are are not required to have a CMTPL policy. Let's look at them in detail.

1. Military vehicles and equipment of the AFU

Vehicles registered for:

  • by the Armed Forces of Ukraine,

  • by the National Guard,

  • by the State Special Communications Service,

  • Border Guard,

  • by the Foreign Intelligence Service,

  • Military formations established on the basis of the laws of Ukraine,

is exempt from compulsory insurance.

But it's important: If the military vehicle is in private use (e.g., sold to a civilian), the benefit ceases to apply.

2. vehicles of operational services

The exemption applies to transportation:

  • the police,

  • of the fire and rescue service,

  • an ambulance,

  • of the emergency units.

These vehicles are considered high priority transportation and are used exclusively for operational purposes.

3. vehicles of diplomatic and consular institutions

The right not to take out an MTPL insurance policy is:

  • diplomatic missions,

  • consulates,

  • international organizations that operate in Ukraine officially,

  • Foreign service employees, if their cars are registered as diplomatic transport.

However, many employees drive regular cars - they still need a policy.

4. electric cars and cars with temporary registration in the BPP (combat operations) zone - partial exemption

Temporary exemptions are sometimes introduced for vehicles registered in localities where active hostilities have led to a halt in the work of the registration authorities.
They may provide for postponement compulsory insurance in case of inability to purchase it.

This is a temporary solution that depends on the situation.

5. Autos that are not actually used

If the vehicle:

  • is in the garage,

  • does not travel on public roads,

  • is under repair or mothballed,

its owner doesn't have to buy MTPL - but it's illegal to drive on the road without a policy..

6. Training vehicles of driving schools

Driving school vehicles may have benefits, but only if they are registered to the institution as a training vehicle. Private instructors' cars must be insured.

2. Which drivers mistakenly consider themselves "privileged" - but are obliged to have MTPL insurance

Every year thousands of Ukrainians receive fines due to misinterpretation of the law. Here are the most frequent misconceptions:

"I'm a pensioner, so I can drive without MTPL."

No. Age and social status do not confer any benefits.

"I have an eco-friendly electric car - insurance is not required for them"

It's a myth.
Electric cars are exempt from customs clearance but not insurance.

"I only drive occasionally, so I can drive without a policy."

If the car moves on the road at least once - MTPL insurance is mandatory.

"I have foreign license plates - the law doesn't apply to me."

Applies to.
Foreign-registered vehicles are required to have green card or a Ukrainian policy.

3. What is the proof of entitlement to the benefit?

If your vehicle qualifies as a concessionary vehicle, you need to have:

  • official documents about the ownership of the car,

  • registration certificate,

  • If necessary, departmental proof of use.

The police have the right to check the validity of the benefit.

4. What happens if you drive without MTPL insurance without legal grounds

For the year 2025, the amount of fines is:

  • 850 UAH - if the driver has forgotten the policy at home but has it;

  • 3400 UAH - if you don't have a policy at all.

Also in the event of a car accident:

  • the driver pays for all damages out of my own pocket,

  • the amount can reach hundreds of thousands of hryvnias,

  • in severe cases, it means a lifetime of financial responsibility.

5. Should those who are formally exempted register for MTPL insurance?

Many organizations, even if eligible for the benefit, still enter into voluntary insurance contracts because:

  • no fines, but huge risk;

  • any accident - and all costs are shifted to the driver or organization;

  • Having insurance reduces conflicts with other parties involved in the accident.

In 2025, the cost of MTPL remains affordable and online registration takes minutes.

Conclusion

In Ukraine, there is indeed a list of transportation categories that are legally exempted from obtaining "car insurance".. But this list is much longer than many people realize.
Most drivers are required to have a valid policy, no matter how infrequently they use the car or where it is registered.

If you are not in the military, diplomatic or operational services - you probably need MTPL insurance after all..

Knowing your rights and responsibilities can help you avoid fines and unpleasant surprises on the road, as well as protect you from huge financial risks.
